Prenuptial Agreements

Prenuptial agreements are used when a marrying couple wish to protect their individual assets in the event of a divorce. The Probate and Family Courts in Massachusetts uphold prenuptial agreements so long as they are “fair and reasonable” at the time they were signed and at the time of the divorce. Each party is required to make full financial disclosures to the other. The timing of the execution of a prenuptial agreement is important.  A court may question the validity of an agreement if it is signed too closely in time to the parties’ wedding date. Prenuptial agreements may be used to protect assets, including current assets and inheritance and to avoid debt in the event the marriage ends in divorce.
