Paternity

Paternity actions in the Probate and Family Court address the legal acknowledgement of biological parents.  In instances where a child is born out of wedlock, a Complaint to Establish Paternity may be necessary. A paternity action can be brough by a parent seeking financial support from the other or a parent who wishes to establish legal and physical custody of a child.  The Department of Revenue may also file a Paternity action on behalf of an individual seeking support.  A paternity determination will have impacts on the obligations of a legal parent, including the payment of child support.  Absent a court order, custody of a child born out of wedlock is presumed to be with the Mother.  The attorneys at Tansley | Halloran understand and can provide assistance with the legal complexities of a paternity action in Worcester County and throughout Massachusetts.
